Architectural services are provided under a separate written agreement specific to each project. These Terms supplement but do not replace project-specific agreements. In case of conflict, the project-specific agreement shall prevail.

4.2 Scope of Services

Our architectural services may include:

• Initial consultations and feasibility studies
• Design development and concept drawings
• Planning applications and liaison with local authorities
• Building regulations submissions
• Technical drawings and specifications
• 3D visualisations and renders
• Contract administration and site inspections

The specific services provided will be detailed in your project agreement.

4.3 Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your project requirements
• Provide timely access to the property for surveys and inspections
• Obtain any necessary permissions from third parties (e.g., neighbours, freeholders)
• Make decisions and provide feedback within agreed timeframes
• Pay fees in accordance with the agreed payment schedule
• Inform us of any changes that may affect the project

4.4 Design Ownership

Copyright in all designs, drawings, and documents created by Bradbury Design remains with us until full payment has been received. Upon full payment:

• You receive a licence to use the designs for the specific project
• Designs may not be reproduced or used for other projects without our consent
• We retain the right to use project images and information for our portfolio and marketing (with your approval)

5. Fees and Payment

5.1 Quotations

Fee quotations are valid for 30 days unless otherwise stated. Quotations are based on the information provided at the time and may be subject to revision if the project scope changes.

5.2 Payment Terms

Unless otherwise agreed:

• A deposit may be required before work commences
• Stage payments may be invoiced at agreed project milestones
• Invoices are payable within 14 days of issue
• We reserve the right to suspend work if payments are overdue

5.3 Additional Costs

The following may be charged in addition to quoted fees:

• Planning application fees (payable to local authority)
• Building control fees
• Specialist consultant fees (structural engineers, etc.)
• Additional work requested beyond the original scope
• Expenses incurred on your behalf

6. Planning and Building Regulations

6.1 Planning Applications

While we use our expertise and experience to prepare planning applications, we cannot guarantee approval. Planning decisions are made by the local planning authority and are outside our control. Our fees for preparing and submitting applications are payable regardless of the outcome.

6.2 Building Regulations

We will prepare designs that we believe comply with current Building Regulations. However, final compliance is determined by the Building Control body. Any required amendments will be undertaken, though additional fees may apply for substantial redesign work.

7. Limitation of Liability

7.1 Website

The information on our website is provided for general information purposes only. While we endeavour to keep the information accurate and up-to-date, we make no warranties about the completeness, reliability, or suitability of the information.

7.2 Services

Our liability for any claim arising from our services shall be limited to:

• The fees paid for the specific service giving rise to the claim, or
• The amount recoverable under our professional indemnity insurance

We shall not be liable for any indirect, consequential, or special damages, loss of profit, or economic loss.

7.3 Professional Indemnity

We maintain professional indemnity insurance appropriate to our services. Details are available upon request.

8. Termination

8.1 By Either Party

Either party may terminate a project agreement by giving written notice. Upon termination:

• Fees for work completed to date become immediately payable
• We will provide copies of work completed upon payment
• Unused design work remains our property

8.2 By Us

We may terminate or suspend services immediately if:

• Payment is significantly overdue
• You breach these Terms or the project agreement
• Continuing would require us to act unlawfully or unethically

9. Confidentiality

We will treat all information about your project as confidential and will not disclose it to third parties except:

• As necessary to provide our services (e.g., to consultants, contractors)
• As required by law
• With your consent

10. Disputes

If a dispute arises, we encourage you to contact us first to seek resolution. If we cannot resolve the matter directly, we agree to consider mediation before pursuing legal action. These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

11. Force Majeure

We shall not be liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, strikes, or government action.

12. General Provisions

12.1 Entire Agreement

These Terms, together with any project-specific agreement, constitute the entire agreement between us regarding the subject matter.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
